Distance contract
SIA "Platinum Sales" registration No. 40103474622, legal address Rubenes iela 34-104, Valmiera, Latvia, LV-4201, hereinafter referred to as the online store, provides the content available on the website and provides goods/services in accordance with the Terms of Use set out below.
1.General provisions
If a consumer purchases goods/services through the website, then such a mutual agreement is considered a Distance Contract and is subject to the legal provisions of the Republic of Latvia that regulate distance contracts, including, but not limited to, the "Consumer Rights Protection Law" of the Republic of Latvia, the regulations of the Cabinet of Ministers of the Republic of Latvia "Regulations on Distance Contracts", etc.
2. Making purchases
The prices and specifications of the products sold in the online store are indicated next to the products. To place an order, add the desired products to the shopping cart. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order with delivery is then displayed on the screen. Make the payment for the purchase to complete the order.
Upon purchase of the Goods, the Buyer has entered into a distance contract with the Seller. If the payment is successful, after the purchase is made, a notification will appear on the screen that the Buyer's payment has been received, and the Buyer will automatically receive a Purchase summary and an invoice for the Purchase made by e-mail.
3.Payment terms
The payment currency on the website is euro. You can pay for your purchase by choosing the following payment methods provided by A/S Citadele banka:
∙Latvian internet banking payments: Swedbank, SEB, Citadele and Luminor
∙Visa/Mastercard card payments
Personal data required for making payments is transferred to A/S Citadele banka.
The contract comes into force upon successful payment to the online store's bank account. If for some reason it is impossible to fulfill the order, the Buyer will be informed about this and the paid amount will be refunded as soon as possible, but no later than within 14 days after receiving the notification.
4.Delivery terms
We offer 3 delivery options:
-Omniva parcel machines in the Baltics. Delivery fee in Latvia - 3 euros, in Lithuania and Estonia - 6 euros.
For shipments over 30 EUR, delivery via Omniva parcel machines is free in all Baltic countries.
-Latvian Post delivery worldwide. Delivery fee regardless of order amount - 9.90 eur.
-Free receipt of goods at our store ADDORES in Valmiera, on the 3rd floor of the shopping mall "Valleta".
Average delivery with Omniva parcel machines is 2-3 business days in Latvia, 5 business days in Lithuania and Estonia.
The delivery time via Latvian Post depends on the specific country to which the order is being sent. For more information, see the Latvian Post website.
5. Using a gift card
Gift cards are redeemed in the online store by entering a unique gift card code during checkout. The value of the gift card is applied to the cart amount. Unless otherwise stated, gift cards and discount codes may not be combined with each other.
Free shipping terms are calculated based on the final order amount after all discounts and gift cards are applied. If the order amount does not reach the free shipping threshold after applying a gift card or discount, the selected shipping fee will apply.
6. Right of withdrawal
The Buyer has the right to withdraw from the goods within 14 calendar days from the date of receipt of the Goods. In order to exercise the 14-day right of withdrawal, the goods may only be used for their intended purposes. If the goods are used inappropriately or damaged, if the goods are treated carelessly during use or if the instructions are not followed, if the original packaging of the goods is lost, or if its packaging is significantly damaged, the online store has the right to reduce the amount to be refunded in accordance with the decrease in the value of the goods. In order to exercise the right of withdrawal, you must submit cancellation form. The right of withdrawal must be exercised within 14 days of receipt of the goods. The Buyer covers the costs of returning the goods, except in cases where the reason for the return is that the goods do not comply with the order (for example, an incorrect or damaged product). The Buyer is obliged to return the Goods to the Seller without delay, but no later than 14 days after sending the withdrawal form to the online store, by sending them to the Omniva parcel machine of T/C “Valleta” in Valmiera, Rīgas iela 4, indicating the telephone number. 28292833. After receiving the returned goods, the online store shall immediately, but no later than 14 days, refund all payments received from the Buyer based on the Distance Agreement. The Seller has the right to withhold payment until it has received the Goods or confirmation of the return of the goods from the Buyer. If the Buyer has chosen a shipping method other than the cheapest shipping method offered in the online store, the online store is not obliged to compensate for the excess shipping costs. The online store is not responsible for any delay in fulfilling or non-fulfillment of obligations, or any other type of non-fulfillment caused by circumstances and obstacles beyond the reasonable control of the online store.
7. Consumer rights regarding goods not conforming to the contract
The online store is not responsible for defects that have arisen after the goods have been delivered to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to demand the elimination of the defects of the goods or their exchange for new goods free of charge. If the goods cannot be repaired or replaced, the Seller shall return to the Buyer all payments provided for in the Distance Agreement. The Seller shall provide a written response to the consumer's complaint within 15 days.
8. Processing of the buyer's personal data
The online store processes only the personal data that the buyer has entered when ordering goods, such as name, surname, e-mail, etc.
The online store transfers personal data to transport service provider(s) to ensure the delivery of goods.
If you have explicitly agreed to receive our marketing communications, including newsletters, we may contact you from time to time with information about our services and latest offers. For this purpose, we may process your email address that you provided when signing up for marketing communications. The buyer has the opportunity to opt out of marketing communications by notifying us by writing to [email protected].
9. Dispute resolution procedure
In matters not covered by these terms and conditions, the Buyer and Seller undertake to comply with the laws and regulations in force in the Republic of Latvia.
The Parties shall resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the Parties shall resolve the dispute in the court of the Republic of Latvia, in accordance with the laws and regulations of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred for resolution to the Consumer Rights Protection Center or the court of the Republic of Latvia. The Buyer also has the right to apply to the dispute resolution institutions of the European Union.
